If I would like to purchase a property in Gocek what is the Buying procedure

Buying a property in Turkey is not as complicated as you may think, although it can be time consuming but we aim to make the process as easy as possible for you. You can purchase land and property in your own name , within the borders of municipality areas.When you find your ideal property in Turkey, Gocek Villas Real Estate team carry out the searches on the Title Deed for you, once a property has been chosen. And we ensure that it’s clear of debts and the seller is the person named on the Title Deed. In order to acquire the title of a property, an application has to be submitted to the local Land Registry Office where the property is situated. After carrying out necessary searches and checks by Izmir Aegean Army, the transfer of the title is done by the Land Registry Office.
After deciding what property to go for, a sales contract will be drawn by the parties where it will include the deposit paid directly either to the agent or owner/builder (the deposit can be refundable when stated in the contract), and general conditions of the sale such as payment terms and building specifications.
Right after signing the sales contract you will be guided to the public notary where you will receive a power of attorney to hand to the agent or solicitor to make the necessary checks, surveys, buy the property on your behalf, connecting your utilities (electricity, water, gas)in your name and paying taxes and doing all paper work in order to get the tittle deed on your names.. A copy of the sales contract will be attached to copy of your passport to be submitted to the Turkish army who will apply a security check on your names, the property location and approve to your purchase.
Foreign nationals buying property in Turkey must be approved by the military authorities. Approval is based on cursory checks into the purchaser’s background and the location of the property. The military investigation takes 4-12 weeks depending on how busy things are.
Once all the checks on the property or land have been carried out and the authorisation has been returned from the Ministry of Defence the Title Deeds will be changed into your name.
If I buy a property in Gocek what are the Offical Expenses
Approximate amounts for official expenses:
Notary fee : 180 GBP
Military application fee: 540 GBP
Purchase tax: 3,3% of the declaration value
Land registration fee 130 GBP
Electric and water registration fee 300 GBP
Earthquake insurance fee 55 to 130 GBP.
These amounts are calculated with today’s exchange rate and also these are current amounts and can be changed.
How long it takes before I own the property?
Foreigners can buy property in their own name in certain areas of Turkey, and the process of obtaining the Title Deeds varies from resort to resort. In some areas it is as little as one months, in others, the process can take up to two - three months. A military check is carried out on the property making sure it is not in military zone before the title deeds are authorized.
Can I get a mortgage here in Turkey, to buy property?
Some banks here have processed mortgages for non-nationals to buy a property in Turkey. Alternatively, you can try some of the mortgage advisory services in your country, who can help with arranging a suitable mortgage for you to purchase property abroad. What legal representation should I have when buying a property in Turkey?

What if I want to rent out my property?
Turkey is an ever increasing destination for Europeans, and resorts are also popular with Turkish tourists during the summer months. Long term property rentals are normally on 6 months or 1 year basis. 6 month rentals would normally be for summer months .Properties can also be let out on a daily and weekly basis. Can we bring our own furniture from abroad?
Yes it is possible to bring your own furniture from abroad when you bought a property in Turkey. Some door to door moving companies organizing to move your furniture to your new property. With the new custom laws there is not a lot payment for the duty. But Electrical goods have extra cost because of the tax label ( banderol ). How will I set up Utility Services - Gas, Electricity, Telephone?
As part of the buying process Gocek Villas Real Estate team will assist you to do this. Telephone Lines are offered to non nationals who gets residence permit for 5-10 years in Turkey. Mobile phones with Pay As You Go Cards are readily available.
What about doctors and dentists; is there any National Health equivalent?
There is no such thing as NHS here in Turkey. There are public and private hospitals. The public hospitals are generally used by locals who pay insurance through their jobs. Private treatment is very inexpensive costing on average 60% less than in the Europe. For some specialist treatments sometimes up to 200% less. Dental treatment is the same, with private consultations being a fraction of the cost of in the Europe and with very high standards. Private health insurance is available for those who require it.
The Advance Payment is 50% of the total costs and is due when booking. For receipt of rent contract is the legally binding booking confirmation . When reserving by telephone or e mail the Property Manager will give a fixed option of 7 days until he receives the rent contract and the advance payment. After this period the reservation will lapse automatically.
The advance payment will be subtracted from the total costs of the rent. The final payment is due 4 weeks prior to the renting period without further notice. All bank fees will be paid by the Tenant.
In the case that the final payment is not made within this time this is seen as withdrawal from the rent contract and the advance payment made by the Tenant will be kept as a withdrawal fee. The booked period of rent will then be offered again within two working days. Thus, we kindly ask you to comply with these periods!

The rent does not include an insurance against withdrawal from the rent contract. We recommend to the Tenant to take out such an insurance. The Property Manager is not liable for disturbance of the Tenant 's holidays through force majeure (war, insufficient petrol supply, epidemics, floods, black tide, fire, earthquakes, terrorist attacks et.al.) In this case additional costs emerging are to be paid by the Tenant. In the case that the Property Manager is not able to let the house due to force majeure or other circumstances that the Property Manager has no influence on the Tenant will be able to withdraw from the contract and to be refunded with all payments made. In this case the Tenant will wave any further right of recovery against the Property Manager.
Any cancellation must be made by registered letter or by e-mail. Any cancellation of this agreement by the Tenant must be made by registered letter with receipt of delivery to the address given on this document and the date on which the Landlord receives it will be the relevant one.
• If the cancellation is received more that 90 days before arrival, the Property Manager shall return within thirty days the whole of the advance payment made by the Tenant.
• If the cancellation is received more than 60 days but less than 90 days before arrival, the Property Manager shall return within 30 days 50% of the advance payment made by the Tenant.
• If the cancellation is received less than 60 days before arrival, the Property Manager shall retain the whole of the advance payment made by the Tenant.
The Tenant is obliged to look after the house and its interior with care and also advise his guests and accompanying persons to do so. Noncompliance with this term can lead to loss of the complete deposit and/or the immediate eviction from the house. Due to special circumstances in Turkey we advise you not to throw items (including toilet papers) into the toilet which may lead to blocking of the sewage system.
The Property Manager preserves the right of further claims. Damages existing upon arrival of the Tenant must be immediately announced to the Property Manager who will then immediately take action.
Claims resulting from non advice of damages are not possible.
